Acceptance of terms
These Terms of Service (“Terms”) govern your access to and use of MarkEcho, which is owned and operated by Crimson Insights Technologies LLP. By creating an account, accessing a workspace, or using the service, you agree to these Terms on behalf of yourself and, if applicable, the organization you represent.
Description of MarkEcho
MarkEcho is a SaaS product for trademark and app-store monitoring and enforcement workflow support. The service helps users submit monitoring inputs, run scans, review detections, organize follow-up activity, and manage support workflows.
Accounts and organizations
You may need an account and an organization or workspace to use MarkEcho. You are responsible for providing accurate information, maintaining authorized access, assigning appropriate roles, and keeping account credentials secure. You must promptly notify us of unauthorized access or suspected security issues.
User responsibilities
- Use MarkEcho only for lawful purposes and in compliance with these Terms.
- Provide accurate account, organization, billing, trademark, and monitoring information.
- Confirm that you have the rights and permissions needed to submit trademarks, watch terms, monitoring targets, and related data.
- Review detections, outputs, and workflow records before taking action.
- Keep credentials confidential and ensure users in your workspace comply with these Terms.
Not legal advice
MarkEcho provides monitoring tools, workflow support, and informational outputs. MarkEcho does not provide legal advice, does not create an attorney-client relationship, and should not be relied on as a substitute for legal counsel. You are responsible for consulting qualified legal counsel before making legal, enforcement, or rights-related decisions.
User content and data
You retain ownership of trademarks, monitoring inputs, files, comments, support requests, and other content you submit to MarkEcho. You grant MarkEcho permission to host, process, transmit, display, and analyze that content as needed to provide, secure, support, and improve the service.
App-store and public source data
Listing data, detection data, and related metadata may come from public third-party sources such as app stores, search pages, developer pages, and similar public sources. MarkEcho does not control third-party stores, listings, developers, policies, removals, ranking, availability, or the accuracy of third-party source data.
Acceptable use
You must not misuse MarkEcho. Prohibited activity includes abusing, disrupting, scraping, or overloading the service; reverse engineering or attempting to extract source code except where allowed by law; bypassing access controls; interfering with security; uploading malicious code; infringing others’ rights; or using MarkEcho for unlawful, deceptive, or harmful purposes.
Subscriptions and billing
If paid plans are available, fees, billing periods, renewal terms, usage limits, cancellation options, and included features are described at checkout, in your account, or in an order form. Subscriptions may renew automatically until cancelled. Fees may be non-refundable except where required by law or expressly stated. You are responsible for taxes and for complying with any payment processor terms that apply.
Trials and beta features
We may offer trials, previews, or beta features. These features may be modified, limited, suspended, or discontinued at any time and may be subject to additional terms.
Disclaimers
MarkEcho is provided “as is” and “as available.” We do not guarantee that detections are complete, accurate, timely, or uninterrupted, or that any enforcement effort will succeed. To the fullest extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
Limitation of liability
To the fullest extent permitted by law, MarkEcho and its team will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, data, or business opportunities. Our aggregate liability for claims relating to the service will not exceed the amounts paid to MarkEcho for the service in the twelve months before the event giving rise to the claim, or one hundred dollars if no amounts were paid.
Indemnity
You agree to defend, indemnify, and hold harmless MarkEcho from claims, damages, liabilities, losses, and expenses arising from your content, your use of the service, your violation of these Terms, or your violation of rights or laws.
Suspension and termination
We may suspend or terminate access to MarkEcho if you violate these Terms, create risk for the service or other users, fail to pay applicable fees, or if continued access would create legal or security concerns. You may stop using the service or cancel according to the settings and plan terms available to you.
Changes to the service or terms
We may update MarkEcho and may change these Terms from time to time. If changes are material, we will take reasonable steps to notify users. Continued use after changes become effective means you accept the updated Terms.
Governing law
These Terms are governed by the laws of India, without regard to conflict of law principles.
